   This site has been set up by Wille Boyd, to expose government corruption and wrongdoing at the highest levels, to expose the fact that "fair trials" do not exist in the U.S. District Court in the Eastern District of Missouri.


The District Court in the Eastern District of Missouri is the home of the corrupt court systems that centers around the corrupt municipalities, as that of Ferguson County, Missouri. Which was the home of the late Michael Brown.


 Willie Boyd will provide evidence to prove that federal prosecutors continue to cover up government corruption, by failing to disclose discovery materials that had been hidden from his trial. Some of this nondisclosed evidence was in the form of 1,188 pages of investigative discovery materials. These undisclosed documents, if disclosed, would have exposed the fact that the government was putting on false evidence and perjured testimony. So that the government could maintain its Riggged Judicial System.

Willie Boyd was arrested when he was 47 years old and was released from federal prison at 68 years of age. Now he is seeking justice for twenty years of false imprisonment.

Willie Boyd was unjustly sentenced to 23 years in federal prison for charges of Ex-Felon in Possession of Firearms, that had been ran consecutive to less serious charges to what became a ten count indictment.

Willie Boyd had elected to take a bench trial in front of US District Court Judge Stephen Limbaugh. Knowing he had been framed by crooked cops, one being former St. Louis police officer Bobby Garrett, and corrupt government agents and officials. Some of those officials consisted of former AUSA Gary Gaertner, and the assigned ATF Agent James Green, and DUSM Luke Adler, and others. It was subsequently discovered in 2003 by Willie Boyd. As you will learn, the (assigned case agent) ATF Agent James Green concealed 1,188 pages of investigate documents in an "unofficial case file," that became BATF Case File #02-1078. And that AUSA Gaerter failed to disclose exculpatory evidence on rogue informant Bryant Troupe. The government should have disclosed the discovery materials on Bryant Troupe, at the time of trial, under the government's discovery obligation along with the two discovery letters on Troupe, dated April 15, 1998.

    Willie Boyd continues to seek justice and demands that the government turn over the full disclosure of the 1,188 pages of documents. Plus the full disclosure of the evidence of how it utilized rogue informant Bryant Troupe, who the government paid $2,953.00 for his informant work in the case. The government only acknowledged that Bryant Troupe had been utilized as a paid informant against Mr. Boyd, in February 2014, with the subsequent release under the Freedom of Information Act "FOIA" of two discovery letters dated April 15, 1998.

   Willie Boyd's latest efforts to get the government to turn over the full disclosure of the 1,188-pages of investigative documents, and the documents on rogue informant Bryant Troupe, was on December 28, 2017.   Which Mr. Boyd has received no response from U.S. Attorney Jeffrey Jensen, from the Eastern District of Missouri, at 111 South Tenth St., St. Louis, Mo. 63102.   Mr. Boyd has provided a copy of that request, plus attached affidavits and documents to substantiate the non-disclosures of documents, for your review. see Complaint.

CHARGES BROUGHT AGAINST WILLIE BOYD

   The Government charged Mr. Boyd with a 10-count indictment from the events concerning the unrelated arrest of November 6th, 1995 and February 1st, 1997. The August 1997 indictment dealt with the arrest of February 1st, 1997, which consisted of counts (1), possession with intent to distribute 33 grams of powdered cocaine; (2) Ex-Felon in Possession of a 9MM firearm and (3)(4) Misuse of Social Security Numbers. 


     In the December 12th, 1997 superseding indictment Mr. Boyd used the alias name Billy Jackson, which dealt with the arrest of November 6th, 1995 that added counts 5-10, that consisted of counts (5)(6)(7) Failure to Report Currency Transactions (8)(9) Ex-Felon in Possession of a 357 cal. firearm and (10) Criminal Forfeiture. The Government dropped count 9 prior to trial. 


     As mentioned earlier, Mr. Boyd chose to take a bench trial in front of Judge Stephen Limbaugh, instead of a jury trial. Mr. Boyd challenged the Government's major counts of the indictment, counts (1)(2) and (8). The Possession of 33 grams of powdered cocaine and Ex-Felon in Possession of the 9 mm and 357 cal. firearm.


     Mr. Boyd put on defense witnesses to prove that he was being framed; Sharon Troupe, Muhammad Mateen, Gerald Boyd, Alonzo Wrickerson, Jacqueline Boyd, Devon Wade, Willie Wise, Eric Cole, Wilbert Harris and Lorre Troupe, to challenge the Government's Case-in-Chief. The Government's case against Mr. Willie Boyd was built on circumstantial evidence by law enforcement.

Statement of Facts as to Counts I and II

   The Government contended that Defendant was the owner of a 9mm cal. firearm and 33-grams of powder cocaine (found in a black bag) on February 1, 1997, located in the apartment of Sharon Troupe, at 2091 Victory Way Lane, allegedly found on the floor of the bedroom closet. Defendant was arrested in the apartment on a tip, as a fugitive for parole violation.


Grand Jury Testimony of Sharron Troupe and Muhammad Mateen


   On May 14, 1997, Sharron Troupe and Muhammad Mateen (who were in the apartment of the night of the arrest) testified that the black bag (which contained 33 grams of powder cocaine), and the 9 mm cal. firearm was the property of Bryant Troupe. See: Grand Jury Tr., pp. 7-8 and 33-34.


   Sharron Troupe and Muhammad Mateen, also testified before the Grand Jury, that Bryant Troupe had keys to Sharron's apartment, where the black bag and firearm was found. See: Grand Jury Tr., pp. 14 and 33. 


   On June 11, 1997, Sharron Troupe was called back before the Grand Jury and she testified that the black bag and firearm was her brother's, Bryant Troupe, and she saw the gun in the bag. See: Grand Jury Tr., pp.12-13.


   Sharron Troupe testified at the Grand Jury that Bryant Troupe told her he was doing undercover work with the feds. See: Grand Jury Tr., pp. 9-10 and 13.


   Sharron Troupe, also testified at the Grand Jury that Marshals were putting items in the black bag, items that belonged to defendant, such as wallets, keys, and a planner. See: Grand Jury Tr., pp. 13-14.



EVIDENTIARY TESTIMONY OF GOVERNMENT WITNESSES 


   On October 6, 1997 Joseph Custer testified at the evidentiary hearing that, he found this black bag in an open closet in plain view, and next to the bag was a firearm. See: [Doc. # 25], pp. 78-80.


DUSM Luke Adler, testified at the Evidentiary hearing that the defendant had made a verbal confession to him that the 9mm cal. firearm, found in the bedroom closet was his gun. See: [Doc. # 25], pp. 27-28.



THE GOVERNMENT WITNESSES WHO TESTIFIED AT THE TRIAL TO THE EVENTS AS TO COUNTS I and II


   The Government presented evidence from DUSM Luke Adler and Deputized St. Louis Police Officer Joseph Custer, and Thomas A. Shulze, Latent Print expect, who testified for the Government's to Counts I and II.

 

   Joseph Custer, testified at the trial that he found the 9mm cal firearm on the floor of an open closet, wrapped in a towel. See: Tr. Vol. II, p. 124. (At the trial was the first time Joseph Custer had given testimony he found the gun wrapped in a towel.)


   Luke Adler, testified that Mr. Boyd had made a verbal Confession to him, that the 9mm firearm seized from the closet of Sharron's apartment, was his gun and he kept a gun for his protection. See: TR. Vol. I, pp. 190 191.


   Luke Alder, also gave testimony that he was not involved with the investigation of the defendant, after February of 1997, when questioned by the defense attorney. Nor was Adler out to properties during any investigation of defendant in June of 1997, at any of the following locations: 1403 E. DeSoto, 1435 E. DeSoto, 4212 Shaw, 4161 Flad and 3780 W. Florissant. See: Tr. Vol. II, pp. 23 through 45.


   Thomas A. Shulze, St. Louis Police Officer (Latent Print Supervisor), testified for the Government at the trial, that none of the fingerprints lifted from the items that were in the bag; the 9mm cal. firearm, ammunition or magazine, or any items in the bag, bore the prints of the defendant. DEFENSE WITNESSES WHO TESTIFIED AS TO COUNTS I and II


   Sharron Troupe, testified at the trial that, the black bag and its initial contents in the bag was her brother's Bryant Troupe. See: Tr. Vol. III, p. 25.


   Sharron Troupe, testified at the trial that, Bryant Troupe had keys to her apartment. See: Tr. Vol. III, PP. 25-26.


   Sharron Troupe, testified at the trial that, defendant did not have keys to her apartment at 2901 Way Lane. See: Tr. Vol. III, .pp. 6-7.


   Sharron Troupe, testified at the trial that, Bryant Troupe told her that he had the gun for his protection. See: Tr. Vol. III p. 76.


   Sharron Troupe, testified that, Defendant did not stay in the apartment, and that he did not keep any clothes there. See Tr. Vol. III, pp. 57-58.


   Sharron Troupe, also testified at 'the trial that, DUSM Luke Adler was putting property that belonged to the defendant in the black bag, such as keys, wallets, books and planners. See: Tr. Vol. III, pp. 29, 44 and 89.


   Muhammad Mateen, testified at the trial that, he had seen Bryant Troupe in Sharron's bedroom with a gun. See: Tr. Vol. III, pp. 175-176.


   Muhammad Mateen, testified at the trial that, he had seen Bryant Troupe with the black bag in the apartment. See: Tr. Vol. III pp. 179-181.


   Lorre Troupe, testified at the trial that, Bryant Troupe kept the black bag in her apartment at one time, and Bryant Troupe had broken into her apartment to retrieve the black bag, and at the time of the break-in, Lorre had called the Berkeley Police Department on Bryant Troupe. GOVERNMENT'S REBUTTAL WITNESS, MICHAEL NEAL


   Michael Neal (Detective for City of Berkeley), testified at the trial that there was no police report of the break-in of 8817 Carson Court in January of 1997 concerning Lorre Troupe's report to the police that Bryant Troupe had broken into her apartment and retrieved the Black bag. See: Tr. Vol. III, pp. 300-302.



DEFENSE WITNESSES TESTIFIED AT THE TRIAL THAT THEY HAD ENCOUNTERS WITH DUSM LUKE ADLER IN JUNE OF 1997, WHILE ADLER WAS INVESTIGATING DEFENDANT


   The defense put on several witnesses at trial, Gerald Boyd, Alonzo Wrickerson and Jacqueline Boyd, to dispute the testimony of DUSM Luke Adler, that he was not involved in the investigation of the defendant after February of 1997. To show that Luke Adler was not a credible witness, and to prove that Adler was harboring a personal bias and was untrustworthy.


   Gerald Boyd, testified at the trial that, he had an encounter with DUSM Luke Adler in the month of June 1997, when Adler used a set of keys seized from his brother (Willie E. Boyd), to open the doors of Boyd's A-1 Auto Repair, at 3780 W. Florissant. See: Tr. Vol. III, pp. 150-156.


   Alonzo Wrickerson, testified at the trial that, he had an encounter with the marshals with the defendant's keys at 1435 E. DeSoto in the month of June 1997. See: Tr. Vol. III, pp. 113-115.

Jacqueline Boyd, testified at the trial that, she saw the marshals leaving the house at 1403 E. DeSoto in the month of June 1997. See: Tr. Vol. III, p. 123.



STATEMENT OF FACTS AS TO COUNT VIII


   The Government contended that defendant was the owner of a 357 cal. firearm seized on November 6, 1995 from the office of the Coles Motel. After allegedly receiving a tip from a

confidential informant, that drugs were being sold from the motel.



OFFICER BOBBY GARRETT WAS THE SOLE WITNESS TO TESTIFY FOR THE GOVERNMENT ON THIS COUNT


   The Government presented evidence from the sole testifying witness as to Count-VIII of the indictment, which was St. Louis Officer Bobby Garrett. Bobby Garrett, testified that he saw a firearm laying on the floor at the feet of defendant. See: Tr. Vol. II, p. 136.


   Bobby Garrett, testified that defendant had keys in his possession upon arrest, on November 6, 1995, to the office and the front door of the Coles Motel, and that the defendant used those keys to lock up the office, where the firearm was found, as well as the Coles Motel, when arrested. See: Tr. Vol. II, p. 140.


   Bobby Garrett, also testified that defendant made a verbal confession to him that the 357 cal. firearm seized from the floor of the Coles Motel, was his gun, and he kept a gun for his protection. See: Tr. Vol. II, p. 141.



DEFENSE WITNESSES WHO TESTIFIED AT THE TRIAL CONCERNING THE EVENTS OF NOVEMBER 6, 1995


   Eric Cole (owner of Coles Motel), testified the defendant was at work at the motel on November 6, 1995 employed as the maintenance man, and was laying floor tile in the hallway of the motel, and that he had let defendant in the office to get those materials and defendant was being assisted by Wilbert Harris. See: Tr. Vol. III, pp. 143-44.


   Eric Cole, testified that the 357, cal. firearm that the officers seized from the office and all the guns seized from the office belonged to his father, and that the guns had been in the office for over 20-years. See: Tr. Vol. III, pp. 239-241 and 247.


   Eric Cole also gave testimony that defendant had no keys to his office in order to lock up the office or the motel. See: Vol. III, p. 267.


   Wilbert Harris (live in resident of Coles Motel), testified that he was assisting defendant laying floor tile in the middle of the motel hallway. See: Tr. Vol. III, p. 213.


   Wilbert Harris, testified that he never saw defendant in possession of a firearm.~. See: Tr. Vol. III, ·p. 224.


   Wilbert Harris·, testified that he knew that the guns where in the office of the motel, and that the guns were Mr. William Coles' guns. See: Tr. Vol. III, p. 230.



THE JUDGE FOUND THE PETITIONER GUILTY AT THIS BENCH TRIAL


   On April 16, 1998 the Trial Judge found the petitioner guilty on Counts 1-8 and 10. See: Tr. Vol. III, pp. 305-307.


   On May 4, 1998 Trial Judge issued a "Memorandum of Decision", finding that the Government's witnesses were more credible than the defense witnesses, and made its finding of guilty in large part, based on the uncorroborated testimony of DUSM Luke Adler and St. Louis Police Officer Bobby Garrett, believing that the petitioner had confessed to Adler and Garrett during separate arrest incidents, he was the owner of the 9mm cal. firearm, on February 1, 1997 and a 357 cal. firearm, on November 6, 1995. CONCLUSION



   AFTER BEING WRONGFULLY CONVICTED BASED ON THE JUDGE'S FINDING OF THE CREDIBILITY OF ROGUE ST. LOUIS POLICE OFFICER BOBBY GARRETT and DEPUTY U.S. MARSHAL LUKE ADLER.   MR. BOYD DILIGENTLY SET OUT TO FIND EVIDENCE TO PROVE GARRETT, AND ADLER, WERE BIAS, PREJUDICE, AND HAD SET OUT TO FABRICATE EVIDENCE TO PUT  MR. BOYD IN PRISON ON FALSE CHARGES.


   On September 9, 1999 Mr. Boyd, filed a Freedom of Information Act lawsuit for investigative records from various agencies, in Boyd v. U.S. Marshals Serv.,  99:2712 (JR). During the litigation the government revealed on April 24, 2002, that they had discovered 1000-pages of documents, that was not a part of the government's official case file.  See: (Government's Extension Motion, pp. 1-2).


   On May 13, 2002 Melissa Blevins, Disclosure Specialist for Bureau of Alcohol, Tobacco and Firearms of the Freedom of Information Division, released or acknowledged documents in its possession, that ATF Agent James Green, had been concealing in an "unofficial case file", which became BATF Case File # 02-1078. This file of investigated documents contained 1, 188-pages of investigative documents, the government released or acknowledged the release of 387-pages and claimed that 592-pages, would be released upon request.  See: (The Released Concealed Documents).


   Over 800-pages of these documents have never been disclosed and most of the released 387-pages of documents have information blacked out (redacted).

 

   On September 9, 1999, Mr. Boyd filed a civil rights lawsuit on behalf of the family, Mary E. DeArmon (mother), Stanley E. Boyd (brother) and Albert Greer (Cousin), against 1 0-St. Louis Mobile Reserve Police Officers, which became case DeArmon, et. al., v. Burgess, et. al., 4:99CV1422(ERW). During the Court ordered discovery in the case, AUSA Gary Gaertner, faxed the Report of Interview of Albert Greer, dated June 6, 1997, to the State's Attorney John A. Bouhasin. This Report of Interview was prepared by ATF Agent James Green (found with the 1,188-pages of investigative documents), and it reveals the fact that DUSM Luke Adler, had been committing perjury at the trial. Because it reveals that DUSM Adler was involved in the investigation in the month of June 1997 of Willie Boyd being that Adler was at 1435 E. Desoto, in June of 1997 and according to the Report of Interview of Agent Green, Adler informed ATF Agent James Green, about a 357 cal. firearm that had been seized from the property.    There has been an ongoing cover-up of the misconduct in this case, with the continued non-disclosure of the investigative documents in the case. There is no logical explanation for the government's continued suppression of the records. 


   When the government acknowledged the non-disclosure of 3,135 pages of investigative documents from Timothy McVeigh's criminal trial, before McVeigh's execution. The government immediately turned over those documents to McVeigh's attorney's.  See: (News Report - New York Times). Why not Mr. Boyd's case? 



ROGUE COP BOBBY GARRETT


   There were many undisclosed investigative documents in the 1,188-pages that dealt with rouge cop Bobby Garrett, which included the undisclosed real St. Louis Police Report. The real police report included the property receipt. Where the property receipt, if disclosed, would have revealed $775.00 dollars had come up missing from Mr. Boyd's seized personal property.  See: (Real Police Report)


   Bobby Garrett, had signed off on Seized Property Form as the seizing officer for the $775.oo dollars. See: (Copy of the unredacted Property Receipt). 


   These investigative documents if disclosed would have revealed that Bobby Garrett, was a rogue cop and not credible back in 1995. 


   On December 13, 2008 the Government indicted rogued St. Louis Police Officer Bobby Garrett, distributing a controlled substance, conspiracy to commit fraud, making false statements, obstruction of justice and theft of government property, along with Vincent Carr, plus another rogue cop Leo Listen (who wore the wire). Bobby Garrett plead guilty and was sentenced to 28-months in federal prison.  See: (Crooked cop articles)


   On September 26, 2011, U.S. District Court Judge Carol E. Jackson, issued court opinion exonerating Michael J. Holmes, based on charges that had been brought in 2003. Bobby Garrett, was presented as a witness against Holmes in regards of a arrest based on a search warrant dated January 5, 1995. Bobby Garrett had gave testimony that Holmes had made an oral statement admitting that he sold drugs, after he found drugs in Holmes possession. Judge Jackson, acknowledged in the court opinion, "As discussed above, the government has acknowledged that is cannot vouch for the credibility of testimony given by Sharp and Garrett 1997 and in 1998-some nine years before Holmes's trial."    It stands to reason, If Garrett had no credibility as far back as 1997 and 1998, then Garrett had no credibility when Mr. Boyd, went to trial on April 13, 1998.


ROGUE INFORMANT BRYANT TROUPE


   The Government's Attorney Gary Gaertner, failed to disclose the discovery materials on Bryant Troupe, at the time of Mr. Boyd's trial. Even though Sharron Troupe, Muhammad Mateen and Lorre Troupe, had gave testimony that the black bag (with 33-grams of powder cocaine) and the firearm was Bryant Troupe's property. 


   It was revealed for the first time through FOIA-litigation in Boyd v. EOUSA, et. al., No. 13CV1304(ABJ), in the full release of two-April 15, 1998, discovery disclosure cover letter, that Bryant Troupe had been used as an informant against Mr. Boyd, on February 27, 2014, and Troupe had been paid $2,953.90 for his undercover work. Troupe had also been used during his investigation of Mr. Boyd to perform other acts, like make a controlled telephone call to Sharron, after she had testified before the Grand Jury in the case.    Mr. Boyd, received some discovery material on Bryant Troupe, (after the trial), that had not been disclosed, dated February 21, 1997 where the government disclosed to the defense in the case, United States v. Miller and Carr, 4:96CR365(CDP). That discovery material reveals, that Bryant Troupe was a paid informant who had gone rogue. AUSA Antoinette Decker, stated, Troupe had acted outside of his cooperation agreement, stating,


"Troupe has informed me that at various times since approximately 1989, he has participated in drug trafficking as a middleman or broker for Byron Miller. He received money for these services from miller or others involved in the sales. This activity was not part of his supervised law enforcement cooperation."  See: (Discovery - Bryant Troupe)


   So in essence, Bryant Troupe, had been a paid informant who had gone rogue, and the government was well aware Troupe was selling crack cocaine for profit. 


   The government can't make a legal or logical explanation for not turning over the full disclosure of the 1,188-pages of investigative documents in the full disclosure of the investigative documents on rogue informant Bryant Troupe, and how the government had been utilizing him. 


   The government is still hiding evidence of perjury of Luke Adler, Bobby and the favorable discovery materials on Bryant Troupe. Everyone would have to agree. The trial had been "RIGGGED" and Mr. Boyd did not receive a fair trial.
